Divorce on the rise due to 'remittance misuse'

GALKOT: The number of divorce cases is increasing every year in Baglung district. According to the District Court, Baglung, divorce cases have been on the rise recently.

After the implementation of the new country code in 2074 BS, the complexity of divorce has become much easier. Lately, either the man or the woman can file a divorce case in the court. Due to this, the number of divorces of both men and women has increased, the court said.

According to Srestedar Surya Prasad Bhandari, District Court, Baglung, 116 divorce cases have been registered in the district court for seven months of the current fiscal year 2077/07. He says there have been 116 divorce cases this year, even though court services have been closed for a long time due to the Corona scare.

In the previous fiscal year 2076/07, 186 divorce cases were registered. Of the 32 divorce cases registered by women and 40 cases registered by men last year, 76 cases of divorce were dismissed out of 22 cases registered by men and 18 cases registered by women.

Forty divorce cases are still pending. Of the 116 divorce cases registered till March 3, this year, 94 cases have been registered from women and 22 cases from men. Out of them, 68 cases registered by women have been settled while eight cases registered by men have been settled. According to Srestedar Bhandari, 40 cases are yet to be decided.

Judge Basudev Neupane of the District Court, Baglung, said that the number of divorce cases has been increasing due to the recent development of foreign employment, misuse of remittances, increasing use of social media, violence against women, and not being able to tolerate injustice.

"Young people get married and go abroad. The practice of settling their wives in the market is on the rise. They want to live a luxurious life in the city. Social media creates suspicion in the husband and wife. Men have also come, in which the issue of character as well as the issue of remittances seems to be the main one. He said that since marriage is a relationship of mutual understanding and consent, both men and women should be responsible.

So far this year, the district court in Baglung has found eight cases related to life, five related to polygamy, 17 related to rape, five related to drugs, nine related to theft, nine related to theft, two related to suicide, two related to child sexual abuse, two related to kidnapping and hostage. According to the District Court, Baglung, there were one case of child marriage, one case of organized fraud, 10 cases of arms, one case of non-compliance with the agreement, one case of obtaining citizenship by submitting false details and eight cases of domestic violence.

Out of 303 cases, 124 have been decided and 179 cases are yet to be decided. Out of 290 newly registered cases this year, 97 have been decided and 194 are left. Of the 593 cases so far, 221 cases have been decided and 372 cases are pending.

The Civil Code, 2020 was replaced by the Civil Code, Civil and Criminal Code, which was enacted on September 20, 2074 BS. The new national law came 164 years after the first national law was issued. Under the new country's law, men can also file for divorce and marital rape cases
