SC authorizes analysis of its own decision

KATHMANDU: The Supreme Court ( SC) has granted permission to review its own verdict on the commutation of the sentence of former APF DIG Ranjan Koirala found guilty of murder.

The SC said that the sentence from Koirala does not even seem to qualify for the commutation as per the Muluki Ain's Clause 188.

In addition, the Apex Court has given three reasons for its decision to revisit the verdict.

Hearing the appeal petition filed by the Attorney General's Office against Chief Justice Cholendra Shumsher Rana and lej 's previous verdict, Bahadur KC, a joint bench of Judges Barn Kumar Shrestha, Prakash Kumar Dnurigana and Kumar Regmi gave permission for the appeal in the verdict.

The joint bench said it was appropriate to revisit the verdict of 0 Rana and Justice KC as former DIG Koirala pleaded not guilty in court, even though he had pleaded guilty with police.

The decision clearly ignored the SC's own precedents, according to the ruling. The bench further claimed that the decision on commuting sentence citing Muluki Ain's clause 188 is against four precedents of the SC.

It should be noted that on June 29, CJ Rana and Justice KC commuted the sentence of Koirala by 11 years by their 'discretionary' powers bestowed upon them by the Muluki Ain.

We had claimed the incident was instigated by the wife. After serving for eight and a half years Koirala was released last Thursday.
